
In 2015, a judge ordered the NYC Brick CrossFit in Chelsea to close its gym after numerous noise complaints. Following the ruling, the gym appealed the decision and has remained open. However, Brick CrossFit members were banned from dropping barbells on the floor.
The plaintiff’s lawyer set up an undercover customer with hidden video to visit the gym four times between September and December 2016. The hidden video allegedly shows gym members violating the rules set forth by the 2015 judge. The plaintiffs are asking the judge to fine the defendants “a substantial sum” for these recent violations.
The attorney for the gym, Jeffrey Kaplan, claims that his clients are not violating the settlement and that “sending in spies” is a violation.
